These Terms of Service ("Terms") govern your use of the AccountPal website at https://accountpal.top ("Website") and the accountability partnership platform and services provided by AccountPal ("Service"). By using our Website and Service, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the Service.

1. Description of Service

AccountPal is a mobile marketplace platform that connects indie hackers and solo founders for one-week accountability sprints. The Service includes:

- AI-powered matching with compatible accountability partners
- Communication tools for daily check-ins and updates
- Video focus sessions for working alongside your partner
- Progress tracking and goal management features
- Escrow payment system for paid partnerships
- Analytics and performance tracking

2. Eligibility

You must be at least 18 years old to use AccountPal. By creating an account, you represent that you meet this age requirement and that all information you provide is accurate and complete.

3. Account Registration and Security

3.1 Account Creation

To use the Service, you must create an account by providing accurate information including your name, email address, and profile details. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Responsibilities

You agree to:
- Provide truthful and accurate information in your profile
- Keep your login credentials secure and confidential
- Notify us immediately of any unauthorized account access
- Accept responsibility for all activities under your account
- Maintain a professional and respectful presence on the platform

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or behave inappropriately toward other users.

4. Subscription and Payment Terms

4.1 Free Partner Accounts

Free partner accounts provide access to basic matching, daily check-ins, video sessions, and communication features at no cost.

4.2 Paid Partner Accounts

Paid partner accounts cost $50 per month and provide:
- Ability to set your own rate ($10-$150 per week)
- Priority matching
- Advanced analytics
- Additional features as described on the pricing page

Subscriptions automatically renew monthly unless canceled. You may cancel at any time through your account settings, with cancellation taking effect at the end of the current billing period.

4.3 Partnership Payments

When engaging in a paid accountability partnership:
- Founders pay upfront at the beginning of each weekly sprint
- Funds are held in escrow via Stripe during the sprint
- Funds are released to the paid partner at sprint completion
- In case of disputes, AccountPal will review activity logs and mediate fairly
- AccountPal charges a service fee on all partnership transactions

4.4 Refund Policy

- Subscription fees: You may cancel your paid partner subscription at any time. No refunds are provided for partial months.
- Partnership payments: Refunds for individual sprint payments are handled case-by-case based on participation and dispute resolution. Contact bartzalewskidev@gmail.com within 48 hours of sprint completion for refund requests.

4.5 Payment Processing

All payments are processed securely through Stripe. By providing payment information, you authorize us to charge the applicable fees to your payment method.

5. User Conduct and Responsibilities

You agree to:

- Treat accountability partners with respect and professionalism
- Participate actively in accountability sprints you commit to
- Provide honest daily check-ins and communication
- Not harass, abuse, or discriminate against other users
- Not use the Service for any illegal or unauthorized purpose
- Not spam, solicit, or promote external services to other users
- Not share misleading information about your experience or projects
- Respect the intellectual property and confidentiality of your partners

6. Accountability Partnerships

6.1 Matching

Our AI algorithm matches partners based on profile information, preferences, and availability. While we strive for compatible matches, we cannot guarantee perfect compatibility or partnership success.

6.2 Partnership Commitment

When matched with a partner, you commit to:
- Completing the weekly sprint (7 days)
- Daily check-ins as agreed upon
- Attending scheduled video focus sessions
- Honest communication about progress and challenges

6.3 Partnership Changes

You may request a new partner match if the current partnership is not working. For paid partnerships, documented lack of participation may result in prorated refunds or service credits.

7. Intellectual Property

7.1 Platform Content

AccountPal owns all rights to the platform, including the website, software, algorithms, logos, designs, and content we create. You may not copy, modify, distribute, or reverse engineer any part of the Service.

7.2 User Content

You retain ownership of information and content you share on the platform. By using the Service, you grant AccountPal a license to use your content to:
- Provide the Service to you and your partners
- Improve our matching algorithms and features
- Create aggregated, anonymized analytics
- Display testimonials or success stories (with your explicit consent)

8. Privacy and Data Protection

9. Third-Party Services

AccountPal integrates with third-party services including Stripe (payments), MongoDB (data storage), Resend (email delivery), and communication tools. Your use of these services is subject to their respective terms and policies.

10. Disclaimers and Limitations

10.1 Service Availability

We strive to keep AccountPal available 24/7, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or technical issues.

10.2 No Guarantee of Results

AccountPal provides tools for accountability partnerships but does not guarantee specific outcomes, business success, or goal achievement. Results depend on your effort and commitment.

10.3 Partnership Outcomes

We facilitate connections between users but are not responsible for the actions, reliability, or conduct of accountability partners. Users engage in partnerships at their own risk.

10.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACCOUNTPAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability to you for any claims arising from the Service shall not exceed the amount you paid to AccountPal in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless AccountPal, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your violation of these Terms
- Your use of the Service
- Your interactions with other users
- Your violation of any third-party rights

12. Dispute Resolution

12.1 Partner Disputes

12.2 Disputes with AccountPal

For disputes with AccountPal, you agree to first contact us at bartzalewskidev@gmail.com to attempt informal resolution before pursuing legal action.

13. Governing Law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles. Any legal action must be brought in the federal or state courts located in Delaware.

14. Changes to Terms

We may update these Terms periodically to reflect changes in our Service, legal requirements, or business practices. We will notify users of material changes via email and by posting the updated Terms with a new "Last Updated" date.

Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service and may close your account.

15. Termination

15.1 By You

15.2 By AccountPal

We may suspend or terminate your account immediately if you:
- Violate these Terms
- Engage in fraudulent or illegal activity
- Harass or abuse other users
- Fail to pay applicable fees

Upon termination, your access to the Service will end, and we may delete your data in accordance with our Privacy Policy.

16. Miscellaneous

16.1 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and AccountPal regarding the Service.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

16.4 Assignment

You may not assign or transfer your rights under these Terms. AccountPal may assign these Terms in connection with a merger, acquisition, or sale of assets.
